1. Who you are contracting with

ElevateOS is provided by Elevation Ops Group LLC ("ElevateOS", "we", "us"). By accessing or using ElevateOS you ("you", the "user") agree to these Terms of Service. If you are using ElevateOS on behalf of an organisation, you confirm that you have authority to bind that organisation.

2. The service

ElevateOS is a leadership operating system that helps managers run one-on-ones, track development goals, manage projects, and score performance. Features and plans may change over time.

3. Accounts

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. Notify us immediately of any unauthorised use.

4. Acceptable use — misuse prohibited

You agree NOT to:

  • use ElevateOS for any unlawful, fraudulent, or deceptive purpose;
  • send spam or unsolicited communications;
  • infringe the intellectual property or privacy rights of others;
  • upload malware or attempt to interfere with the security or integrity of the service;
  • probe, scan, scrape, or reverse engineer the service;
  • resell or redistribute the service, or circumvent technical limits.

5. Intellectual property

ElevateOS and all related software, documentation, designs, and branding are and remain the property of Elevation Ops Group LLC and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms and your subscription plan. You retain ownership of the content you input; you grant us a limited licence to host and process that content solely to provide the service.

6. Payments and subscriptions — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment terms, billing frequency, taxes, renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. You can manage or cancel your subscription via paddle.net.

See our Refund Policy for details. In short, we offer a 30-day money-back guarantee, processed through Paddle.

8. Suspension and termination

We may suspend or terminate your access to the service for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the service at any time. On termination, we will provide a reasonable export window before deleting your data, subject to our legal obligations.

9. Service availability and warranties

ElevateOS is provided "as is" and "as available" without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

10. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the service is limited to the fees paid by you to us (or to Paddle on our behalf) in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold ElevateOS harmless from claims arising out of your content, your unlawful use of the service, or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Disputes shall be resolved in the competent courts of that jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
